Shorkom Platform’s Governance and Legal Policy

Shorkom’s governance and compliance policy ensures transparency, adherence to local and international laws, and protection of user rights. This policy defines the responsibilities and obligations of all parties to guarantee fair and lawful dealings.

Commercial Use License

  • License: A perpetual, non-transferable, global, exclusive license is granted for the commercial use of deliverables for permitted purposes only. This license is valid solely for the purposes outlined in this document.
  • Intellectual Property Rights: Service providers retain all ownership rights related to products or services delivered through the platform.
  • Permitted Commercial Purposes: Include advertising, promotion, and integration into products or programs. Unlawful, unethical, or defamatory uses are strictly excluded.
  • Compliance with Terms: The license is subject to Shorkom’s terms and conditions, with no warranties provided. Shorkom or the service provider are not liable for any claims or damages arising from the use of the license or deliverables.

Responsibilities of Parties

  • Service Providers’ Responsibility: Service providers are fully accountable for the quality of services provided and ensuring compliance with the legal and commercial standards outlined in the agreement.
  • Shorkom’s Responsibility: Shorkom is not liable for any claims or damages arising from service delivery by service providers, as responsibility lies with the providers.

Terms of Use

  1. Registration: Users must register on the platform, providing accurate and complete information, including name, email, and phone number.
  2. Permissible Use: The platform is strictly for lawful purposes. Unlawful or deceptive activities are prohibited.
  3. Payments: Shorkom specifies accepted payment methods, including credit cards, bank transfers, or other approved options. Payments must be made as per the agreements in service requests.

Updates to Terms

  • Shorkom reserves the right to update terms and conditions periodically. Users will be notified of changes via email or platform notifications.
  • Users are responsible for reviewing the terms regularly to ensure compliance with the latest updates.

Article 1: Legal Compliance

  • Commitment to Laws: Shorkom and its users must adhere to all relevant local and international laws governing e-commerce and trade agreements.
  • Applicable Laws: Shorkom operates under Omani laws, with international laws applied as necessary. These include:
    • Omani Laws:
      • Omani Commercial Law.
      • Electronic Transactions Law (Royal Decree 69/2008).
      • Consumer Protection Law (Royal Decree 66/2014).
      • Intellectual Property Laws.
    • International Laws:
      • General Data Protection Regulation (GDPR).
      • International e-commerce agreements.
  • Disputes are subject to Omani jurisdiction unless both parties agree on an alternative resolution method.

Article 2: Governance and Responsibilities in Dispute Resolution

  1. Disputes:
    • Disputes between service providers and requesters are resolved through Shorkom’s mechanisms, which include arbitration and consumer protection.
  2. Mechanisms for Dispute Resolution:
    • Shorkom Mediation: As the default dispute resolution process.
    • Independent Arbitrator: If mediation fails.
    • Oman Arbitration Center: For unresolved disputes.
  3. Timeline for Dispute Resolution:
    • Disputes must be resolved within 30 days of filing the complaint.
  4. Final Rulings:
    • Arbitration or legal decisions are binding for all parties.

Article 3: Governance Principles and Platform Responsibilities

  1. Governance Principles:
    • Transparency: Clear communication of policies and updates to users.
    • Integrity: Adherence to professional and ethical standards in service delivery.
    • Accountability: Ensuring a safe and organized environment for all interactions.
  2. Shorkom’s Responsibilities:
    • Operational: Managing the platform and ensuring compliance with laws.
    • Technical: Providing technical support and resolving platform-related issues.
  3. Limitations of Liability:
    • Shorkom is not responsible for disputes between users unless directly involved in the contract.
    • Its role is limited to platform management and facilitating a reliable service environment.

Article 4: License and Commercial Use

  1. License Rights:
    • Users are granted a non-transferable license to use services for lawful purposes only.
  2. Permitted Use:
    • Includes advertising, promotion, and integration with products or programs.
    • Excludes unlawful, offensive, or harmful content.
  3. Intellectual Property:
    • Service providers retain all rights to intellectual property related to their services.

Article 5: Data Protection and Compliance

  1. Data Protection:
    • Personal data is collected and processed per Shorkom’s Privacy Policy.
    • Advanced technologies ensure data security against breaches or misuse.
  2. Compliance:
    • Shorkom regularly updates its policies to align with local and international regulations.
  3. User Rights:
    • Users can access, update, or request deletion of their personal data, except where retention is legally required.

Article 6: Permitted Ages

  • 18 and Above: Full platform access is granted.
  • 12–18 Years: Access requires parental or guardian consent.
  • Under 12: Access is restricted to child-specific services with full parental supervision.

Article 7: Unauthorized Usage

Shorkom prohibits:

  • Inappropriate Behavior: Including harassment or hate speech.
  • Fraudulent Activity: Attempts to compromise member security or spread harmful content.
  • Impersonation: False identities or misrepresentation.

Article 8: Legal Provisions

  1. Warranties:
    • Service providers guarantee the quality of their services as per the agreed terms.
  2. Ownership:
    • The platform, including its design, content, and functionality, remains Shorkom’s exclusive property.
  3. Intellectual Property Claims:
    • Shorkom responds to valid copyright and trademark infringement claims.
  4. Feedback Rights:
    • Feedback submitted by users becomes Shorkom’s intellectual property, with no obligation to implement it.
